Running the Chain of Title

The “Chain of Title” is the historical timeline of ownership for a property. Our examiners track the transfer of the property from owner to owner to ensure there are no “breaks” or missing links. We verify that every previous seller had the legal right to transfer the property and that all deeds were executed and recorded correctly.

To provide the highest level of certainty, we adhere to strict industry standards for search depth:

  • Residential Sales:We perform a minimum 42-year
  • Commercial Transactions:We perform a minimum 60-year

These extended search periods allow us to identify long-standing easements, mineral rights, or restrictions that could impact your use of the property today.

Comprehensive Title Examination

Beyond ownership, we look for anything that might “cloud” the title or represent a claim against the land. This involves a rigorous search of county records for:

  • Liens & Judgments:Unpaid taxes, homeowner association dues, or court-ordered judgments against previous owners.
  • Mortgages:Ensuring all prior loans have been fully paid off and “released” of record.
  • Easements & Rights of Way:Identifying third-party rights to use the land (such as utility companies or shared driveways).

Legal Descriptions: Verifying that the physical boundaries described in the deed match the official tax maps.

Photocopies of Title Exceptions

Transparency is key to our process. If our search uncovers “exceptions”—legal items that will stay with the property after the sale, such as utility easements or building restrictions—we don’t just tell you they exist.

We provide photocopies of the actual recorded documents for these exceptions. This allows you, your lender, and your legal counsel to review the exact language of the restrictions, ensuring there are no surprises regarding how you can build on or use your new property.
